Domain Names & Cyberspace IP

Your brand exists online before it exists anywhere else. Cybersquatters, impersonators, and counterfeiters exploit the internet to profit from your reputation. We protect domain names, social media identities, e-commerce listings, and all forms of online intellectual property through both rapid arbitration and court proceedings.

UDRP & INDRP Domain Disputes

For .com and other generic TLD disputes, ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP) provides a faster, cheaper alternative to court. For .in domains, NIXI's INDRP applies. We draft and file complaints before approved dispute resolution service providers — WIPO, NAF, NIXI — to reclaim cybersquatted domains.

  • → UDRP complaint drafting and filing (WIPO/NAF/ADNDRC)
  • → INDRP (.in domain) complaint before NIXI
  • → Response drafting in UDRP/INDRP proceedings
  • → Transfer and cancellation orders enforcement

Social Media & Online Impersonation

Fake social media accounts, impersonator pages, and infringing usernames damage brand trust and mislead consumers. We handle IP-based takedown requests on Instagram, Facebook, YouTube, LinkedIn, and X (Twitter), and escalate to court where platform processes fail.

  • → Trademark-based takedown requests on Meta, YouTube, X
  • → Impersonation complaint filing on social platforms
  • → Username recovery through platform IP policies
  • → Court injunctions where platform remedies are inadequate

E-Commerce IP Enforcement

Counterfeit and infringing product listings on Amazon, Flipkart, Meesho, Myntra, and other marketplaces erode your brand and revenues. We execute comprehensive marketplace enforcement campaigns — from brand registry enrollment to bulk takedowns and seller account shutdowns.

  • → Amazon Brand Registry enrollment and IP complaint filing
  • → Flipkart, Meesho, Snapdeal IP complaint management
  • → Repeat infringer seller account suspension campaigns
  • → Test purchase and evidence gathering for offline follow-up

Online Brand Monitoring & Strategy

Prevention is cheaper than cure. We advise brands on a defensive domain registration strategy (securing brand.in, brand.co.in, brand.net etc.), set up monitoring for new domain registrations similar to your mark, and advise on Trademark Clearinghouse enrollment for new TLD launches.

  • → Defensive domain portfolio registration strategy
  • → Trademark Clearinghouse (TMCH) registration
  • → New domain registration watchdog alerts
  • → Annual online brand health audit

Frequently Asked Questions

Someone registered a domain name using my brand name. What can I do?
If you have a registered trademark, you can file a UDRP (for generic TLDs like .com) or INDRP (for .in domains) complaint. You must prove: (1) the domain is identical or confusingly similar to your mark, (2) the registrant has no legitimate right to it, and (3) it was registered and is being used in bad faith. A successful complaint results in domain transfer within weeks — far faster than going to court.
Do I need a registered trademark to file a UDRP complaint?
While a registered trademark strengthens your UDRP case significantly, unregistered (common law) trademark rights are also recognized. You need to demonstrate that your mark has acquired a secondary meaning or reputation in trade. However, registered trademark owners have a considerably higher success rate in UDRP proceedings.
How long does a UDRP domain dispute take?
A standard UDRP proceeding takes approximately 45-60 days from complaint filing to decision. After a decision in your favor, the domain registrar implements the transfer within 10 business days (subject to any court stay by the losing party). INDRP proceedings for .in domains follow a similar timeline.
Can I take legal action in India against a cybersquatter?
Yes. Beyond UDRP/INDRP, you can file a suit for passing off or trademark infringement in Indian courts, seek an Anton Piller order for evidence seizure, and obtain an injunction requiring the domain registrar to freeze and transfer the domain. Indian courts have regularly granted relief against cybersquatters, including cases decided by the Delhi High Court.
