Patents Act, 1970 & PCT

Patent Law: Filing, Prosecution, Commercialisation & Litigation

A patent grants a 20-year monopoly on a novel, non-obvious, and industrially applicable invention. Our patent lawyers and registered patent agents in India handle the complete lifecycle — from prior art search (patentability search) and provisional patent filing to complete specification drafting, reply to First Examination Report (FER), patent hearing representation, PCT international patent applications, and High Court patent infringement litigation.

01.

Comprehensive searches of Indian and global patent databases to evaluate novelty and non-obviousness before committing to filing. We provide a written patentability search report and opinion.

02.

Provisional & Complete Patent Drafting

We draft provisional specifications (establishing priority date) and complete specifications with precise claims for software patents, AI patents, medical device patents, pharmaceutical patent drafting, mechanical patents, and electronic patent filing.

03.

FER Reply & Patent Hearing

Structured written responses to First Examination Reports, overcoming prior art objections and Section 3 exclusions, followed by representation at Patent Office hearings before the Examiner or Controller.

04.

PCT International Filing

Filing international patent applications under the Patent Cooperation Treaty (PCT) with WIPO, followed by national phase patent filing in India for foreign applicants, and national phase entry in target jurisdictions at 30-31 months.

05.

Expedited Examination (Startups)

DPIIT-recognised startups, small entities, and female inventors are eligible for expedited patent examination in India, significantly reducing grant timelines. We manage the full request and follow-up process.

06.

Patent Litigation & Revocation

We pursue pre-grant opposition patent, post-grant opposition patent, and patent invalidation suits before the High Court. Designs Act, 2000

Industrial Design Registration & Protection

Industrial design registration protects the unique visual features of a product — its shape, configuration, pattern, ornamentation, or combination of colours. Registration under the Designs Act, 2000 grants a 10-year monopoly (extendable by 5 years) over the registered design. We handle design registrations for consumer products, apparel design registration, UI/UX design protection, packaging designs, and furniture. We also litigate design infringement suits and pursue cancellation of registered designs.

Confidential Information & Restrictive Covenants

Trade Secrets, NDAs & Confidentiality

India does not have a dedicated trade secrets statute, but trade secret protection is enforced through contractual obligations (NDAs, employment agreements) and common-law breach of confidence actions. We draft and enforce Non-Disclosure Agreements (NDAs), employee confidentiality agreements, non-compete agreements, and handle litigation arising from corporate espionage, data theft by employee, and client list misappropriation.

Frequently Asked Questions

IPR Legal Questions — Answered by Our Advocates

The following questions reflect the most common queries we receive from founders, businesses, and creators seeking IP legal guidance in India.

Trademark registration in India is governed by the Trade Marks Act, 1999. The process begins with a comprehensive trademark search (covering phonetic, visual, and Vienna classification similarities) to identify potential conflicts. Once cleared, you file Form TM-A with the Trade Marks Registry. After examination, if no objection is raised, the mark is published in the Trade Marks Journal and, upon expiry of the opposition window, proceeds to registration. Startups and MSMEs recognised by DPIIT are eligible for expedited registration and a 50% concession on government fees.
The official government fee for trademark registration is ₹4,500 per class for individuals, startups, and small enterprises (MSME), and ₹9,000 per class for large entities. Advocate/agent fees are charged separately. Contact us for a precise estimate based on the number of classes and jurisdictions required.
The ™ (TM) symbol may be used by any trademark applicant immediately upon filing, even before registration is granted. The ® (Registered) symbol may only be used once the trademark has been formally registered. Unauthorised use of the ® symbol is an offence under Section 107 of the Trade Marks Act, 1999.
When the Trade Marks Registry raises an objection under Section 9 (absolute grounds: descriptiveness, lack of distinctiveness) or Section 11 (relative grounds: similarity to a prior mark), you must file a written response within 30 days. The reply must be supported by legal arguments, evidence of use, prior-registration citations, and where applicable, a request for a Show Cause Hearing before the Hearing Officer. Failure to respond results in deemed abandonment of the application.
If your brand name or logo is being used without authorisation, you may: (1) send a cease and desist letter demanding immediate cessation; (2) file a civil suit for trademark infringement (if registered) or passing off (if unregistered) before a Commercial Court or High Court seeking an interim injunction, permanent injunction, and damages; (3) file a criminal complaint under Sections 103 and 104 of the Trade Marks Act; and (4) seek marketplace takedowns from platforms such as Amazon or Flipkart through their brand protection portals.
Software (computer programmes) and source code qualify as literary works under Section 2(o) of the Copyright Act, 1957. Copyright registration is voluntary but provides prima facie evidence of ownership. The application is filed with the Copyright Office along with two copies of the work and the prescribed fee. You should also consider pairing copyright protection with an NDA and proprietary source code escrow agreements.
A pure software algorithm or business method, as such, is not patentable under Section 3(k) of the Patents Act, 1970. However, a novel technical application — such as a mobile app that solves a technical problem through a new and non-obvious software-hardware combination demonstrating a technical effect — may be patentable. Our patent attorneys conduct a detailed patentability analysis before advising on filing strategy.
A patent granted in India has a term of 20 years from the date of filing of the complete specification (Section 53, Patents Act, 1970). Annual renewal fees must be paid from the third year of grant onwards. Failure to pay renewal fees results in the patent lapsing, although it may be restored within 18 months upon application.
The Patent Cooperation Treaty (PCT) is an international treaty administered by WIPO that allows an inventor to file a single international application simultaneously seeking protection in up to 157 contracting states. The application enters a national/regional phase (typically at 30-31 months from the priority date) in each desired jurisdiction. India is a PCT member and the Indian Patent Office acts as an International Searching Authority.
Trademark infringement requires a registered trademark and occurs under Section 29 of the Trade Marks Act when an identical or deceptively similar mark is used without authorisation. Passing off is a common-law tort protecting unregistered marks; it requires proof of goodwill or reputation in the mark, a misrepresentation by the defendant, and actual or likely damage to the claimant. Both remedies may be pursued simultaneously.
Under Section 63 of the Copyright Act, 1957, copyright infringement is punishable with imprisonment of not less than 6 months (extendable to 3 years) and a fine of not less than Rs. 50,000 (extendable to Rs. 2,00,000). Civil remedies include Anton Piller orders (search and seizure), interim and permanent injunctions, delivery up of infringing copies, and an account of profits or statutory damages.
No. Copyright arises automatically upon the creation of an original work under Section 17 of the Copyright Act, 1957 — no registration is required. However, registration creates a public record and constitutes prima facie evidence of ownership and the date of creation, which is highly valuable in infringement litigation. For commercially significant works such as software, films, music catalogues, and books, we strongly advise registration.
A cease and desist letter is a formal legal notice sent to an infringing party demanding that they immediately stop the infringing activity (e.g., using your trademark, reproducing your copyrighted content, selling counterfeit goods). It sets out the legal basis for the claim, the specific acts of infringement, and a deadline for compliance before legal proceedings are initiated.
A startup idea, as such, is not protectable — but its expression, implementation, and branding are. A comprehensive startup IP audit typically involves: (1) Trademark registration for brand name, logo, and product names; (2) Copyright registration for source code, content, and creative assets; (3) Patent filing for novel technical inventions (provisional first, then complete specification); (4) NDAs and Confidential Disclosure Agreements with co-founders, employees, and investors; (5) Founder IP Assignment Agreements ensuring all IP is formally assigned to the company; and (6) Trade secret protocols for proprietary algorithms and client data.
Domain name disputes arise when a third party registers or uses a domain name that is identical or confusingly similar to your trademark with bad faith intent (cybersquatting). For generic top-level domains (.com, .net), disputes are resolved under ICANN's UDRP. For .in domains, the INDRP applies. Proceedings are administered by WIPO Arbitration and Mediation Center or NIXI. Our advocates represent complainants and respondents in both UDRP and INDRP arbitrations.
Standard Essential Patents (SEPs) are patents that cover technology essential to implementing a technical standard (e.g., 4G/LTE, Wi-Fi, Bluetooth). Holders of SEPs are required to license them on Fair, Reasonable, and Non-Discriminatory (FRAND) terms. India has seen increasing SEP litigation before the Delhi High Court. Our IP litigation team advises both SEP holders and implementers on FRAND negotiation, valuation, and litigation strategy.
A patent agent is registered with the Indian Patent Office (IPO) under the Patents Act, 1970, and is qualified to prosecute patent applications before the IPO. A patent lawyer (advocate) is enrolled with a State Bar Council and is authorised to appear in court for patent litigation, infringement suits, and revocation proceedings. Many IP law firms maintain both patent agents and advocates to provide integrated prosecution and litigation services.
A DMCA takedown notice requires the platform (YouTube, Instagram, website host) to remove allegedly infringing content. If you receive a strike or takedown that is unjustified, you may file a DMCA counter-notification within 10-14 business days, asserting your right to use the content (e.g., original creation, fair use, licence). Our advocates assist creators with both offensive DMCA filings to remove stolen content and defensive counter-notifications to restore wrongly removed content.
A Geographical Indication (GI) tag identifies goods originating from a specific geographical region whose quality or reputation is essentially attributable to that geographic origin. GI registration in India is governed by the Geographical Indications of Goods (Registration and Protection) Act, 1999. Famous Indian GIs include Darjeeling Tea, Basmati Rice, Kancheepuram Silk, and Phulkari embroidery from Punjab.
An IP audit is a structured review of all intellectual property assets owned by or licensed to a business. It identifies what IP exists, who owns it, how it is protected, and what risks exist (e.g., employee ownership claims, missing assignments, unregistered marks). For startups, an IP audit is essential before investor due diligence, M&A transactions, Series A fundraising, and international expansion. A clean IP title is increasingly scrutinised by institutional investors and acquirers.

Glossary of Intellectual Property Terms

Key legal terms used across trademark, copyright, patent, and design law in India — explained in plain language.

Anton Piller Order

An ex parte court order requiring a defendant to permit the claimant to enter their premises to search for, inspect, and seize infringing evidence or materials. Named after the UK case Anton Piller KG v Manufacturing Processes Ltd.

Cease and Desist Letter

A formal legal demand requiring a party to stop an allegedly unlawful activity (e.g., trademark infringement, copyright infringement) and refrain from repeating it, typically before court proceedings are initiated.

Cybersquatting

The bad-faith registration of a domain name identical or confusingly similar to a trade mark or brand name with intent to profit from its resale or divert traffic. Resolved under UDRP (for gTLDs) or INDRP (for .in domains).

DMCA Takedown

A process under the U.S. Digital Millennium Copyright Act (applied globally by platforms) permitting copyright owners to demand removal of infringing content from online platforms. A counter-notice may be filed if the takedown is unwarranted.

FRAND Licensing

Fair, Reasonable, and Non-Discriminatory licensing terms — the obligation placed on holders of Standard Essential Patents (SEPs) to license their technology to all implementers on an equal, non-exploitative basis.

Geographical Indication (GI)

A sign used on products that have a specific geographical origin and possess qualities, reputation, or characteristics essentially attributable to that origin. Governed by the GI of Goods (Registration and Protection) Act, 1999.

John Doe Order

An injunction granted against unknown defendants — called 'Ashok Kumar' orders in Indian courts — used in IP cases against anonymous internet infringers or unidentified counterfeiters whose identities are not yet known.

Madrid Protocol

An international treaty administered by WIPO allowing a trademark owner to seek protection in multiple member countries through a single application filed in their home country's trademark office, designating target countries.

Nice Classification

The international classification of goods and services for trademark registration purposes, comprising 45 classes (Classes 1-34 for goods, Classes 35-45 for services), established under the Nice Agreement of 1957.

Passing Off

PCT (Patent Cooperation Treaty)

An international patent filing treaty administered by WIPO allowing inventors to seek patent protection in up to 157 countries through a single international application before entering national phases.

Prior Art

Any evidence that an invention was already known before the filing date of a patent application. Prior art includes earlier patents, published papers, prior use, and public demonstrations. It determines novelty and non-obviousness.

Provisional Patent Application

A preliminary patent filing under the Patents Act, 1970 that establishes a priority date for the inventor without requiring a complete specification. The complete specification must be filed within 12 months.

Trade Secret

Confidential business information — formulas, processes, customer lists, algorithms — that derives commercial value from its secrecy. Protection is contractual (NDAs, employment agreements) rather than statutory in India.

Vienna Classification

The International Classification of Figurative Elements of Marks, used to categorise the visual elements of device marks (logos) for trademark search and registration purposes before the Trade Marks Registry.

Work for Hire

A work created by an employee within the scope of employment or by an independent contractor under a written agreement, where copyright vests in the employer or commissioning party rather than the individual creator.
