Statutory Infringement vs Common Law Passing Off

Indian trademark jurisprudence provides dual avenues of protection depending on the registration status of the commercial mark:

Trademark Infringement (Section 29)

A statutory remedy available exclusively to the proprietor of a registered trademark. Under Section 29, infringement occurs when a person uses an identical or deceptively similar mark in the course of trade for identical or similar goods/services without authorization.

Key Evidentiary Advantage:

No requirement to prove actual consumer confusion or market damage; deceptive similarity and identity of goods/services establish a legal presumption under Section 29(3).

Passing Off (Common Law Tort)

Preserved under Section 27(2) of the Act, passing off protects the commercial goodwill of unregistered marks and established brand names against deceptive misrepresentation by competitors.

The Classical Trinity Test:

The plaintiff must establish: (1) goodwill or reputation attached to the goods/services, (2) misrepresentation by the defendant leading or likely to lead the public to believe that goods offered are of the plaintiff, and (3) actual or probable damage.

Judicial Remedies in Commercial Court Suits (Section 135)

Under Section 135 of the Trade Marks Act, 1999 and the Commercial Courts Act, 2015, the remedies available to a trademark owner in a civil suit include:

Ex-Parte Interim Injunctions

Securing emergency restraining orders under Order XXXIX Rules 1 & 2 CPC on the very first date of hearing to immediately halt the sale and manufacture of infringing goods.

Anton Piller (Local Commissioner) Orders

Court appointment of an advocate Commissioner to conduct unannounced search and seizure of infringing inventory and stock at factories, warehouses, and distributor hubs.

John Doe (Ashok Kumar) Orders

Ex-parte injunctions issued against unknown or anonymous counterfeiters, permitting law enforcement and online intermediaries to block mirror domains and rogue seller accounts.

Damages & Rendition of Accounts

Seeking compensatory damages for commercial losses and brand dilution, or demanding full rendition of accounts to disgorge profits earned by the infringing party.

Marketplace Enforcement & Criminal Remedies

Modern brand theft occurs predominantly across digital channels and unauthorized marketplace seller hijacking. We execute brand gating, notice-and-takedown protocols with Amazon, Flipkart, and Meesho, and initiate domain recovery under INDRP for cybersquatting.

Where large-scale counterfeiting syndicates operate, we initiate criminal prosecution under Sections 103, 104, and 115 of the Trade Marks Act, coordinating with police authorities for search, seizure, and criminal FIR registration.

Pre-Litigation Action Checklist

  • • Evidence Trap Purchases: Certified purchases with tax invoices proving marketplace distribution.
  • • Cease & Desist Notices: Formal legal notices demanding immediate cessation and disclosure of supplier networks.
  • • Commercial Court Jurisdiction: Filing before High Courts having territorial jurisdiction where plaintiff resides or carries on business under Section 134(2).
  • • Section 12A Compliance: Invoking urgency exemptions under Commercial Courts Act when seeking interim ex-parte injunctions.
