Plant Varieties & Farmers' Rights
India's Protection of Plant Varieties and Farmers' Rights Act, 2001 (PPV&FR Act) provides a unique sui generis system that simultaneously recognizes plant breeders' rights and farmers' traditional rights. This dual framework — unique in the world — requires specialized legal expertise to navigate effectively.
Plant Variety Protection (PVP) Registration
A new plant variety can be protected under four categories: New, Extant, Farmers', and Essentially Derived Varieties (EDVs). We guide plant breeders and agri-biotech companies through the DISTINCT, UNIFORM, STABLE (DUS) test requirements and file complete applications at the Plant Varieties & Farmers' Rights Authority (PPV&FRA), New Delhi.
- → DUS test advisory and documentation preparation
- → Application filing for New, Extant, and EDV varieties
- → Denomination (variety name) selection and clearance
- → Prosecution and follow-up at PPV&FRA
Breeders' Rights Enforcement
A certificate of registration grants the breeder exclusive rights to produce, sell, market, distribute, and export the variety. We enforce these rights against unauthorized seed multipliers, infringers, and counterfeit variety sellers through civil and criminal proceedings.
- → Infringement notices against unauthorized seed dealers
- → Civil suit for infringement and account of profits
- → Criminal prosecution under Section 64-65 of PPV&FR Act
- → Opposition proceedings before PPV&FRA
Farmers' Rights Advisory
Under the PPV&FR Act, farmers have the right to save, use, sow, re-sow, exchange, share, or sell their farm produce — including protected varieties — subject to not selling branded seed. We advise farmers' groups, NGOs, and cooperatives on the scope and limits of these rights.
- → Farmers' rights scope and limitation advisory
- → Variety denomination registration for farmers' varieties
- → Community rights representation
- → Gene fund benefit-sharing claim advisory
Agri-Biotech IP Strategy
For agri-biotech companies developing new crop varieties through conventional breeding or genetic modification, a comprehensive IP strategy often involves both PVP registration and patent protection for the underlying biotechnology. We coordinate these overlapping rights for maximum commercial protection.
- → PVP + patent dual protection strategy
- → Technology transfer and licensing agreements
- → Seed company IP portfolio audit
- → International PVP through UPOV Convention countries
