Semiconductor Integrated Circuit Layout Designs

India's Semiconductor Integrated Circuits Layout-Design (SICLD) Act, 2000 provides specific IP protection for the three-dimensional configuration of the elements and interconnections of a semiconductor integrated circuit — protecting the substantial investment and creative effort that goes into chip design against unauthorized copying.

Layout Design Registration

Registration of a layout design is not mandatory for protection — rights arise automatically upon commercial exploitation — but registration creates a public record, shifts burden of proof in infringement proceedings, and provides additional remedies. We handle filing at the SICLD Registry under the Ministry of Electronics and IT.

  • → Layout design registrability assessment
  • → Application preparation and filing at SICLD Registry
  • → Examination response and prosecution
  • → Certificate of registration and recordal maintenance

Infringement Enforcement

Reproducing a protected layout design — or incorporating it into a semiconductor product without authorization — constitutes infringement under the SICLD Act. We pursue infringers through civil injunctions, damages claims, and customs enforcement against infringing chip imports.

  • → Reverse engineering and copying analysis
  • → Cease-and-desist notices and legal demands
  • → Civil suit for infringement and damages
  • → Customs border enforcement against infringing imports

Semiconductor IP Strategy

For fabless chip companies, semiconductor IP cores businesses, and EDA (Electronic Design Automation) software vendors, a multi-layered IP strategy is essential. We coordinate layout design protection, software copyright, patent protection for novel circuit architectures, and trade secret protection for proprietary design methodologies.

  • → SICLD + Patent + Copyright layered protection strategy
  • → IP portfolio audit for chip design companies
  • → Trade secret protection for design methodologies
  • → IP due diligence for semiconductor M&A transactions

IP Licensing & Technology Transfer

Semiconductor IP cores (like RISC-V implementations, DSP blocks, or memory IP) are frequently licensed to chip manufacturers. We draft and negotiate IP core licensing agreements, foundry IP agreements, and technology transfer arrangements that protect your layout design rights while enabling commercial exploitation.

  • → IP core licensing agreement drafting
  • → Foundry (fab) IP protection clauses
  • → Technology transfer agreements
  • → Royalty structuring and escrow arrangements

Frequently Asked Questions

What exactly is a "layout design" under the SICLD Act?
A "layout design" means a three-dimensional disposition, however expressed, of the elements (at least one of which is an active element) and of some or all of the interconnections of an integrated circuit. In plain terms, it is the unique spatial arrangement of transistors, resistors, and connections that define a chip's functionality.
Is registration mandatory to get protection under the SICLD Act?
No — protection arises from the date of first commercial exploitation anywhere in the world, or upon creation of the layout design (whichever is earlier), regardless of registration. However, registration is highly advisable because it creates a public record, simplifies enforcement, and strengthens claims in infringement proceedings.
How long does SICLD protection last?
Protection under the SICLD Act lasts for 10 years from the date of first commercial exploitation or from the date of filing of the application for registration, whichever is earlier. Unlike copyright or patents, there is no renewal — the 10-year term is absolute.
Can a layout design also be protected under copyright law?
The SICLD Act is a lex specialis (specific law) for semiconductor layout designs. While the underlying design files (GDSII, Verilog, VHDL) and artwork may attract copyright protection as artistic/literary works, the layout design as applied to a physical chip is primarily governed by the SICLD Act. We advise on the optimal combination of protections for each situation.
